Summary of Terms and Conditions
The Expert Mathematician website is dedicated exclusively to marketing its namesake program; as such we do not advertise or make available other products.
Four components, constitute The Expert Mathematician (TEM) program. In its promotional release, upon purchase, a license is granted to use all components in one school building without time limitation, and with succeeding groups of students. Free trial samples are offered upon login with official school email. The Logo software application students use for interactive dynamic learning, is distributed as freeware, meaning it can be flexibly used without monetary costs, but comes with restrictions. See further information below.
Additionally, the Terms discuss availability of TEM lesson materials as free trial media, or full versions for purchase. Pricing and payment matters are also detailed as are license and copyright protections and restrictions on lesson content and software use and distribution. Ordering, warranties and liability limitations are also discussed, as are exclusions, product acceptability and performance expectations.

Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:
Country refers to: Minnesota, United States
Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to First Principles Educational Solutions, Minnesota.
Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
Orders mean a request by You to purchase Products/media from Us.
Products/media refer to the items offered for free or paid on the Service.
School building is defined as a legally established place where students receive instruction by certified providers and routinely meet for scheduled classes during a specified time period.
Service refers to the interactive part of our website operated by logging in to download any type media—free or paid—from the Website.
TEM refers to the middle school mathematics program, The Expert Mathematician, that is offered for sale on our website.
Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
Third-party Service means any services or content (including data, information, media/products or services) provided by a third-party that may be displayed, included, essential for processing orders or made available by the Service.
Website refers to Improving Middle School Mathematics, accessible via https://www.sales.expertmath.org
You means the individual accessing or using the Service, or the Company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and First Principles Educational Solutions (a.k.a., the Company). These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service. Access or use of any part of the Company’s website will be considered proof of acceptance of these provisions.
If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.
Placing an Order
By placing an Order for one of our Products posted for sale through our Service, You warrant that You are legally capable of entering into binding contracts.
Your Information
If You wish to place an Order for one of our products available on the Service, it will be necessary to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.
By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.
Order Cancellation
We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:
- Product availability
- Errors in the description or prices for media normally sold on our website.
- Errors in Your Order
We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.
Your Ordering Rights
If Your order is properly placed and payment process is complete with your prior express consent, the product will be immediately shipped to You via email attachment and We will receive email notification that the order has shipped. Since all Our products are provided as digital or in PDF format, and are not delivered on tangible media, once an Order is shipped You are assumed to have acquired possession of its contents and Your posession cannot be reversed—therefore upon completion of your Order returns or refunds cannot be provided. That is why we strongly encourage prospective purchasers to obtain and try our Free Samples prior to placing an Order. An order can be cancelled at any time prior to completing payment.
Free Samples—Try Before You Buy
Prospective Users of TEM will find a generous package of software and lesson materials that support conducting TEM and that students use as active learners, providing a helpful preview of how the complementary elements of TEM can provide an engaging and productive learning and teaching experience. Free samples are available after signing in with your official school email.
Limitations of Use
You agree that a singular purchase of our TEM products may be used exclusively in a single licensed school building, for successive instructional periods with newly enrolled students.
Availability, Errors and Inaccuracies
We occasionally update Our offerings of Products sold on the Service. The Products available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Products on the Service and in Our advertising on other websites.
We cannot guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services.
Pricing Policy
If You present a current screenshot with verifiable reference of a previously posted price lower than currently posted, your Order will be honored at the previous price.
Payments
All products purchased are subject to a one-time payment in full. Payment can be made through various payment methods we have available, such as Visa, MasterCard, Affinity Card, American Express cards or online payment methods (PayPal, for example).
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.
Intellectual Property
The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors.
The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

1a. Turtle Tracks is a modern Logo interpreter and runtime environment written entirely in Java. It is not a direct port of an existing interpreter, but written from the ground up specifically for Java, and designed to take advantage of the strengths of Java as a platform. More….

1b. PowermathTM Logo (also known as PowerMathTM Logo, a.k.a. PM Logo): Definitions and Permissions:
PM Logo is a unique, fully implementable cross platform version of the Logo computer language that makes use of, but does not modify, the “Turtle Tracks” code base.
PM Logo is distributed as a freeware (as in “cost-free”) unique, copyright and trademark protected, software application, written in the Java coding language, enabling implementation across the MS Windows PC, Apple Macintosh and Linux operating systems that are Java enabled. PM Logo may be freely downloaded from the vendor’s website to determine suitability for intended use.

You agree that, as proprietary freeware software, PM Logo must not be modified, its code must not be used for derivative works, nor may it be reverse engineered.
You agree that the PM Logo software application that students routinely use in actively processing their lessons is provided free of monetary charge, and that PM Logo must not be:
- sold or traded for anything with assumed monetary value;
- may not be incorporated in or with any commercial product or media whether tangible or digital.
1c. Supplementary skill games and teacher files (collectively, “the supplementary files”) develop students’ calculation skills. They are written in Logo, are legally copyrighted to Dale Hulme, are included as “freeware” and are provided AS IS for use EXCLUSIVELY by end users at the licensed TEM school building.
Therefore:
You agree that the supplementary files must NOT BE distributed to non-licensed users, and specifically:
- the supplementary files must not be sold or traded for anything with assumed monetary value;
- apart from TEM, the supplementary files must not be incorporated in, or in any way associated with, any commercial product or media, whether in tangible or digital format.
- You understand and accept that the supplementary files are “open coded” and, although they have been validated as properly functional at the time of shipping, may be easily corrupted due to experimental modification or improper use. Secure backup copies are the exclusive responsibility of end users and neither the developer, copyright owner, nor publisher or distributor can be liable for any of the supplementary files found to be malfunctioning.

You understand that, as their code is accessible and may be accidentally or intentionally modified, rendering them inoperable, the supplementary files are offered with AS IS disclaimer of warranty of operability or liability for loss of time or progress.
2. TEM Printable Lesson Media: Single School Building License
Copyright notice: TEM lessons are provided in printable PDF format, presented in 3 volumes (any of which may be purchased and used independently) that are legally copyrighted to Dale Hulme. Lesson pages are intended to be printed for use at a licensed school building only, for instruction on successive days through the school year—and may be continuously used during successive school years in the licensed building.
You understand that Licensing and pricing policies may change over time.
Posted prices of individual TEM purchases permit licensees’ use of all materials in a single purchased download for unlimited use in one individual school building of a legally established school organization.
We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.
Termination
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use materials sold by the Service will cease immediately.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for institutional interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms, even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.
“AS IS” and “AS AVAILABLE” Disclaimer
The Service and its products are provided to You “AS IS” and “AS AVAILABLE” and with any faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.
United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
